An affidavit is a written statement confirmed by oath or affirmation, for use as evidence in court. It's more than just a signed document; it carries the weight of legal responsibility. The person making the affidavit—called the "affiant"—swears before an authorized official (like a notary public) that the contents are true and accurate to the best of their knowledge.

Affidavits focus on facts within the affiant's knowledge, not opinions, arguments, or speculation. They're often used to present sworn facts without live testimony, especially when someone can't be present in court—because they live far away, are ill, or have another serious obstacle. Instead of testifying live, their sworn statement can be submitted as evidence.

You might encounter affidavits in a variety of legal contexts: divorce proceedings (detailing assets and events), criminal cases (from witnesses or investigators), immigration applications (verifying information about the applicant), or even small claims court (presenting your side of a dispute).

The format of an affidavit is very specific, requiring clear headings, numbered paragraphs detailing facts, and a concluding statement swearing to the truthfulness of the contents. A false affidavit can lead to serious legal consequences, including perjury charges. So, while it's a written account, an affidavit holds the same power as spoken testimony under oath—making accuracy and honesty paramount.
